ACHAT Privilege - Conditions of participation

1. Customer relations

1.1 ACHAT Hotel- und Immobilienbetriebs GmbH [ACHAT Hotel and Real Estate Company] rewards ACHAT Privilege members for their customer loyalty. Each participant in the ACHAT Privilege programme chooses to accept the following conditions of participation by giving their consent through placing a tick on the registration form and using the ACHAT Privilege card.

1.2 Any individual person who is over 18 years old can become an ACHAT Privilege customer. Participation is free of charge. Each customer receives an ACHAT Privilege card with their customer number.

1.3 Please inform ACHAT Hotels Deutschland of changes to your personal registration details by telephone, in writing or on our website, www.achat-hotels.com.

2. Benefits for ACHAT Privilege customers

Members can identify themselves as ACHAT Privilege customers with their ACHAT Privilege card at any ACHAT Hotel- und Immobilienbetriebs GmbH hotel and thereby benefit from the following services during future overnight stays at the hotel reserved by booking directly on our website www.achat-hotels.com or by telephone / email:

  • Free upgrade from a business class room to a superior room (depending on availability)
  • Free double room supplement
  • Free breakfast
  • Preferential treatment in high season / last room availability
  • Dish of fruit provided by room service
  • 20% discount on food and drink in restaurants and bars belonging to the hotel

3. Membership pre-requisites

ACHAT Hotel- und Immobilienbetriebs GmbH checks the volume of overnight stays of the corresponding guest during registration for ACHAT Privilege. Only individual persons can become an ACHAT Privilege member. In addition, the following volume of overnight stays must be reached:

  • At least 20 overnight stays must have been generated by the individual guest (individual person)

The volume of overnight stays is automatically recorded by the reservations software of ACHAT Hotels on every visit. ACHAT Privilege customers can receive information on their current volume of overnight stays on request at ACHAT Hotel- und Immobilienbetriebs GmbH hotels by stating their customer number.

4. ACHAT Privilege benefits in the form of payment

Services belonging to the ACHAT Privilege benefits (see Point 2) cannot be provided by payment. There is no legal claim to payment.

5. Validity of the ACHAT Privilege card

The ACHAT Privilege card retains its validity as long as the card holder is an ACHAT Privilege member.

6. Loss of the card

6.1 The card holder must keep their ACHAT Privilege card safe and protect it from misuse.

6.2 The ACHAT Privilege card is intended for the exclusive use of the card holder. It is non-transferable.

6.3 ACHAT Privilege members must inform ACHAT Hotel- und Immobilienbetriebs GmbH immediately if the ACHAT Privilege card is lost or there is suspicion that a third party is using it.

6.4 In the event of loss of the ACHAT Privilege card, the card holder can apply for a replacement card with ACHAT Hotel- und Immobilienbetriebs GmbH.

7. Termination and changes to the general conditions of participation

7.1 Members can end their participation in the ACHAT Privilege programme at any time without prior notice in text form or in writing to ACHAT Hotel- und Immobilienbetriebs GmbH.

7.2 Termination by ACHAT Hotel- und Immobilienbetriebs GmbH is permitted only with appropriate prior notice, insofar as the cancellation does not occur without notice for important reasons. The termination will be in writing. Card holders are obliged to make the ACHAT Privilege card unusable starting from the end of the cancellation term, in the event of termination for important reasons on receipt of the cancellation. The benefits listed in Fig. 2 are duly cancelled on coming into effect of the termination.

7.3 ACHAT Hotel- und Immobilienbetriebs GmbH reserves the right to cancel, supplement or change the ACHAT Privilege programme with appropriate prior notice, in the presence of an important reason without such notice, whilst appropriately safeguarding the interests of members, as well as to change or supplement these conditions of participation insofar as this is in the interest of effective and more secure processing and especially where required to prevent misuse. ACHAT Privilege members will be informed of changes in writing and in advance to their last known address. A change counts as approved if members do not cancel within a month of the date of the postmark of the notice according to Fig. 7.1 or when members use their ACHAT Privilege card or customer number further with ACHAT Hotels after the end of this term. ACHAT Privilege members will be separately informed of this again in the notice.
The current version of the conditions of participation can be viewed at any time on the internet or in ACHAT Hotels.

8. Miscellaneous

Exclusively German law applies. If the customer does not have a general domestic court of jurisdiction, the place of jurisdiction is Mannheim.

Notes on data protection for the ACHAT Privilege programme

The security of your personal information and its confidential handling are of the utmost importance to us. We would therefore like to take the opportunity to inform you of how, to what extent and for what purposes we collect, process and use your personal data to ensure your eligibility to participate in the ACHAT Privilege programme.

2. Data processing by ACHAT Hotel- und Immobilienbetriebs GmbH

Customers wishing to register for the ACHAT Privilege programme must before conclusion of contract share their personal details, which are required to provide the benefits under the ACHAT Privilege programme. Necessary information is separately marked, whereas other information is optional. ACHAT Hotel- und Immobilienbetriebs GmbH processes and uses the personal data of ACHAT Privilege members to send them the ACHAT Privilege card and further information on this programme as well as to provide the benefits named in Fig. 2 of the conditions of participation. The legal basis for this is the EU General Data Protection Regulation (GDPR) Art. 6 para 1 clause 1 lit. b).

A customer account is created through registration for the ACHAT Privilege programme. The information provided by customers is revocably stored. Customers may receive information on matters relevant to their customer account, e.g. technical changes, by email. If participation in the ACHAT Privilege programme is terminated, the data of participants relating to the customer account will be deleted, subject to legal retention obligations.

3. Rights of affected persons

You have the right:

  • in accordance with EU GDPR Art. 15 to demand access to information on your personal data which is processed by us. In particular, you can demand access to information on the purposes of processing, the category of personal data, the categories of recipients to whom your data has been or will be made accessible, the planned duration of storage, the existence of the right of amendment, deletion, limitation of processing or appeal, the existence of the right of complaint, the origin of your data, insofar as not collected by us, as well as on the existence of automated decision making including profiling and, where relevant, significant information on the details;
  • in accordance with EU GDPR Art. 16 to demand the immediate amendment of your personal data as stored by us if incorrect or incomplete;
  • in accordance with EU GDPR Art. 17 to demand the deletion of your personal data as stored by us, insofar as processing is not required for the exercise of the right of freedom of expression and information, for the fulfilment of a legal obligation, or for reasons of the public interest or for the enforcement, exercise or defence of legal claims;
  • in accordance with EU GDPR Art. 18 to demand the limitation of processing of your personal data, insofar as the accuracy of the data is disputed by you, the processing is unlawful, or you refuse to consent to its deletion and we no longer require the data, whilst you however require it for the enforcement, exercise or defence of legal claims or you have made an appeal against the processing according to EU GDPR Art. 21;
  • in accordance with EU GDPR Art. 20 to access, in a structured, conventional and machine-processable format, your personal information which you have made available to us, or to demand its transfer to another responsible person;
    in accordance with EU GDPR Art. 7 para 3 to revoke at any time your consent previously granted to us, with the consequence that we will no longer be permitted in future to continue with data processing based on this consent and
  • in accordance with EU GDPR Art. 77 to raise a complaint with a supervisory authority. In general, you can approach the supervisory authority in your usual place of residence or workplace or at our company headquarters.

If your personal data is processed based on authorised interests according to EU GDPR Art. 6 para 1 p. 1 lit. f, you have the right to make an appeal against its processing according to EU GDPR Art. 21, insofar as there is reason arising from your particular situation or the appeal is against direct advertising. In the latter event, you have a general right of appeal, which can be implemented by us without disclosure of a particular situation. If you wish to make use of your right of cancellation or appeal, an email to datenschutzbeauftragter@achat-hotels.com will suffice.
